I have the honor to sponsor today propose Senate Bill number 2115 under committee report number 59 or an act strengthening the rights of peace. rate workers providing for strict reportorial requirements and penalties for violations thereof otherwise known as the anti-abuse of pacyawan workers act at the outset this measure may seem unnecessary given that we already have the labor code the wage rationalization

act and corresponding dole issuances that defined and regulate the peace rate system it provided safeguards with the intention to protect the rights of peace rate workers Pero hindi po ito ang realidad. Taon-taon na lang po may pupunta sa programa ko na mga Pacquiawan workers na hindi nababayaran ng maayos o d naabuso sa patakaran ng mga kumpanya.

 Kaya naman pagdating ko dito sa senado, isa ito sa mga pinaaral ko kung ano ang pwedeng gawin para matigil ng pangaabuso sa Pacquiawan workers. Nag-ikot ako sa iba’t ibang industriya upang malaman kung ano ba ang problema. Panoorin po natin ang maiksim video kasi wala po kaming mga benefits dito sir. Tapos sa salari po sir.

workers in several key areas first prior to the adoption of a peaceweight scheme it shall be mandatory for employers to file an application with the relevant regional tripartite wages and productivity board or RTWPB for conduct of a time and motion study which shall serve as basis for theance renewal or updating of peace rate order.

Second, workers who have rendered at least 8 hours of work in a day should be compensated not lower than the applicable minimum wage in the area. Third, this measure will mandate the posting of an approved peace rate order in the workplace where it could be access by all the workers for purposes of verifying the salary computation.

Fourth, it shall be mandatory for the RTWPB to maintain an accurate and updated database of all issued peace rate orders and for the dole to require the submission of sworn certifications from every employer stating among others that the adjustment shall be adopted by the company following the release of a new wage order.

wage order failure to apply for and conduct a tms corresponding penalties in the form of fins suspension of operation or closure of business shall be meted against violators. The penalty shall be graduated based on the gravity of the violation number of workers, duration and frequency of violation and the size and capacity of the enterprise. Mr.

President and dear colleagues, huwag nating hayaan na ipagpatuloy ang ganitong sistema ng Pacquiawan na walang pananagutan ang mga lumalabag na employers. Ang ating mga Pacquiawan workers ay mga taong may karapatan at pangangailangan din. Hindi sila mga kagamitan at makina na babayaran lang pagtapos na ang kota sa produksyon.

While we cannot abolish this payment scheme which has long been adopted by several industries. We cannot simply allow this peace rate system to be a mechanism for exploitation either. Hindi natin hangad na patayin ang mga industriya lalo na mga manufacturing industries kung saan libo-libong mga manggagawa ang umaasa.

 Nais lang natin na paigtingin ang mga umiral na regulasyon. Bigyan ng batas. Panagutin ang mga violators at ayusin ang implementasyon ng sistema sa Pacquiawan. It is time to bring the law closer to them, making the rights of peaceweight workers a tangible reality rather than just a provision on paper. I urge my dear colleagues to support the passage of this measure.

 A measure that seeks to strengthen the rights and welfare of Filipino workers compensated under peace rate or Pacquia. We would like to put on record our sincer thanks and gratitude and congratulate as well our presidential candidate Senator Raffy Tulfo, our dear friend for pursuing and pushing for this very important piece of legislation. Ginoong pangulo, marami po sa ating mga kababayan ang nagtatrabaho sa sistemang Pacquiawan.

Mga Pilipinong araw-araw kumakayod para may maihain sa haagkainan. Mga manggagawang binabayaran hindi batay po sa oras ng trabaho kundi sa dami ng kanilang natatapos. Habang mas marami po silang nagagawa, mas malaki sana ang kita. Pero sa realidad po hindi ito laging patas. May mga manggagawa pong halos hindi na magpahinga. Kakahabol ng kota.

 May mga nagtatrabaho mula umaga hanggang gabi pero pagdating po ng sweldo kulang pa rin ang pambayad sa renta. Kulang pa rin ang pambayad sa kuryente, sa tubig at sa pagkain. Si President, some workers spend the entire day sewing garments, carrying heavy loads, packing products, processing materials or assembling goods piece by piece.

 Yet at the end of the day their earnings still fall below the minimum wage. At masakit po rito, kadalasan wala silang malinaw na basehan kung paano kinukwenta ang kanilang sahod. Basta trabaho lang ng trabaho. Kapag bumagal ang output, bawas agad ang kita. Kapag nagtanong o nagreklamo, nangangambang mawalan ng trabaho. Ginoong pangulo, hindi po dapat ganito ang kalagayan ng manggagawang Pilipino.

And that’s why this particular bill seeks to correct this injustice. Under this measure as mentioned a while ago by our distinguished sponsor all peace rate compensation systems must be supported by proper and scientific production standards through time and motion study or TMS.

 Ibig po sabihin Ginoong pangulo, magkakaroon na po ng malinaw at patas na batayan kung makatotohanan nga po ba ang kota at ah sapat po ba ang bayad sa mga manggagawa. Importantly, Mr. President, this bill guarantees that workers who render at least 8 hours of work shall receive no less than the applicable minimum wage regardless of the output produced.

Nakakalungkot po isipin, Mr. President, na we have to put this in the law kahit na napaklarong ito na yung pinakamatarungan at makataong ah pulisya. Mr. President, simple lang po ang prinsipyo natin dito. Kapag buong araw kang nagtrabaho, dapat sapat naman ang maiuwi mo sa iyong pamilya.

 Hindi pwedeng pagod na pagod ka na pero gutom na gutom pa rin ang mga anak mo. Gutom na gutom pa rin ang iyong mahal sa buhay. Ginoong pangulo, kinikilala po natin ang malaking papel ng mga industriya sa pagbibigay ng trabaho sa ating mga kababayan. But we also believe, Mr. President, that businesses grow stronger when workers are treated fairly.

 Kapag maayos po ang pasahod, mas ganado ang manggagawa. Kapag may dignidad ang trabaho, mas matatag ang pamilya. At kapag mas matatag ang pamilya, mas matatag ang bayan. Kaya mga kasama dito sa bulwagang ito sa panahon pong ngayon na mataas ang presyo ng bilihin at hirap ang maraming pamilyang Pilipino. Tungkulin po nating tiyakin na walang manggagawang Pilipino ang naaabuso at naiwan sa kanilang sipag.

 Umiikot ang ekonomiya ng ating bansa. Panahon na po para tiyakin natin na hindi nasasayang ang kanilang pagod. With this, Mr. President, I respectfully give my full support for the immediate passage of this very important piece of legislation.
